Sales Policy
It is our policy to sell to the OEM and wholesale level only. Possession of a price book does not constitute an offer to sell. Prices are subject to change without notice. All orders will be shipped and invoiced at the prevailing price at the time of shipment. We reserve the right to adjust orders to standard package quantities unless otherwise stated on purchase order. All orders are subject to acceptance by Barry E. Walter Sr. Co., 2550 E. Platte Ave., Fort Morgan, CO 80701. The Minimum billing is $50.00. Drop shipments will carry a 10% surcharge and must meet minimum requirements.
Terms
3% 20, Net 30. Payment must be received electronically within 20 days of the invoice date for the discount to be allowed. Any amount past due is subject to a finance charge on the total past due balance in accordance with the truth-in-lending act. Invoices not paid according to the terms are subject to MONTHLY SERVICE CHARGES of 1 1/2% per month (which is an ANNUAL PERCENTAGE RATE OF 18%). Returned checks (NSF) will be charged a $25.00 handling charge. Prices are subject to any federal, state, sales use or other tax applying, unless exemption certificates are on file with Barry E. Walter Sr. Co. Cancellation of regular merchandise orders can be authorized only by Barry E. Walter Sr. Co. Handling charges may be assessed for canceled orders.
Freight
All orders will be shipped FOB Fort Morgan, Colorado. Shipping charges will be prepaid and added to the invoice unless different arrangements have been made.
Returns
No goods will be accepted for return unless authorized by Barry E. Walter Sr. Co. in advance of return. Return goods are subject to a minimum 20% handling charge plus freight. All material returned without prior written permission will be assessed a minimum of 50% plus freight.
Claims
Claims for shortage must be made within five days after receipt of shipment. Items defective in material or workmanship will be replaced without charge. It is expressly understood that Barry E. Walter Sr. Co., liability is limited to furnishing of such replacement parts and that Barry E. Walter Sr. Co. will not be liable for any damages, losses, or expenses arising in connection with the use of or inability to use our products for any purpose. Damaged shipments must be made available to the carrier or transportation company for inspection.
Special Material
Materials made to the specifications of the customer by Barry E. Walter Sr. Co. are not returnable. Once an order has been placed it cannot be canceled. Barry E. Walter Sr. Co. reserves the right to charge a $50.00 research fee to identify and quote on customer special requests.
General
Barry E. Walter Sr. Co. represents that it has complied with the Fair Labor Standards Act of 1938, as amended, and the Fair Employment Practice Act. All Catalogs, Price List, and Product Information Publications remain the property of Barry E. Walter Sr. Co. We also stock many items which are not currently included in our catalog and are constantly adding replacement parts. If you don't find the item you need, just ask!
